Upon reading this day at the Board a Representation from the Lord's Commissioners for Trade and Plantations dated the 9: of this instant setting forth that John Swan Esqre one of His Majesty's Council in the Province of North Carolina is dead and it being
usual and expedient for His Majesty's service that the Chief Justice of the several Colonies should have Seats in the Councils of those Colonies respectively the said Lords Commissioners propose that Charles Berry Esqre whom His Majesty was graciously pleased in March 1761. to appoint Chief Justice of North Carolina may be appointed of His Majesty's Council in that Province in the room of the said John Swan Esqre deceased—His Majesty in Council approving thereof is pleased to order as it is hereby ordered that the said Charles Berry Esqre be constituted and appointed a Member of His Majesty's Council in the said Province of North Carolina in the room of the said John Swan Esqre deceased—And that the Right Honourable the Earl of Egremont one of His Majesty's principal Secretarys of State do cause the usual Warrant to be prepared for His Majesty's Royal Signature accordingly—
