Sir:

I do myself the honor to address to your Excellency the Copy of an Agreement entered into by the Commissioners appointed to settle an exchange of prisoners of War in the Southern Department. This agreement is accompained by a List of American Officers captured in that District who were not then exchanged.

Notice will be given in the Gazettes that the names of those Officers are transmitted to the Executive authority of each State. Should any applications be made to your Excellency on the subject, I beg leave that the Officers may be informed whether their names are contained in the enclosed List or not. This mode of advising

the Officers is preferred to a publication of the list, for reasons which will occur to your Excellency, and which are offered in excuse for the liberty of troubling you with this business.

Articles of Agreement for the relief and exchange of the prisoners of War taken in the Southern Department, acceded to at Accabee on the 23rd of October, 1782, by Major Wemyss, Deputy Adjt. General, on the part of the Honorable Lieutenant General Leslie, and Major Burnet on the part of the Honorable Major General Greene.

1st. That all non-commissioned Officers and privates who have been delivered previous to the date hereof be considered as exchanged and properly accounted for.

2ndly. That all the British prisoners of War now in the American Army, including those lately at George Town, be sent to Charles Town as early as possible, and be considered as exchanged.

3rdly. That an immediate exchange of regular Officers, as far as similar rank will apply, shall be effected and the paroles of the unexchanged Officers be extended agreeably to their wishes.

4thly. That all Militia and Citizens, both American and British, taken as Prisoners of War by either army in the Southern department previous to the date of this agreement, be considered as hereby exchanged, and those who may be now in confinement be immediately liberated.

I do certify that in consequence of an agreement entered into at Accabee this day by Major Burnet on the part of Honorable Major General Greene, and Major Wemyss, Deputy Adj. General, on the part of the Honorable Lieut General Leslie; all militia both Officers

and privates and all Citizens of every denomination made prisoners of War by the American Army in the Southern Department previous to the date hereof are regularly exchanged.

Provision and necessary passports will be granted to such as are inclinable to repair within the British Lines; or any other part that may be most agreeable to them.

Given at Accabee in South Carolina the 23d day of October, 1782.

I do certify that in consequence of an agreement entered into at Accabee this Day by Major Wemyss, Depty. Adj. General, on the part ot the Honorable Lieut. General Leslie, and Major Burnet on the part of the Honorable Major General Greene, all the Militia, both Officers and Privates, and all citizens of every denomination made prisoners of War by the British Army in the Southern Department previous to the date hereof are hereby regularly exchanged.
