At the Court at St James. the 30th day of April 1761.
Present.
The King's most Excellent Majesty in Council.

Whereas there was this day read at the Board a Report made by the Right Honourable the Lords of the Committee of Council for Plantation Affairs, upon considering a Representation and Report from the Lords Commissioners for Trade and Plantations, together with several other Papers relating to the Suspension of John Rutherford and James Murray Esqrs from their Seats in the Council of North Carolina, by the Present Council of that Province—His Majesty taking the said Report of the Committee of Council into His Royal Consideration, was pleased with the Advice of His Privy Council, to approve thereof, and agreable to what is therein proposed to order, as it is hereby Ordered that the said John Rutherford Esqre be restored to his Place and Rank in the Council of North Carolina, and that the Lords Commissioners for Trade and Plantations do cause his Name to be inserted in the Instructions now preparing for the Governor of the said Province But that with respect to James Murray Esqr His Majesty doth hereby Order that his Name be not inserted in the said Instructions but a Blank left therein until such time as a further Inquiry can be made into his past Conduct and Behaviours
